According to the attorney who represents the employees, 15 workers in Palisades Park, Bergen County, have filed a workers’ compensation claim, alleging that they became ill from mold at the municipal complex.
Andrew R. Bronsnick wrote to Councilman Jae K. Park and Mayor Paul Kim on Wednesday that the borough had failed to respond to the medical and health concerns of the workers.
Bronsnick claims in his letter that he brought up the issue with Kim in February, but hasn’t heard anything back. He also says nothing has been taken to correct the supposed environmental hazards.
Park was included in Park’s letter, as he had been appointed by the attorney in September to supervise the mold remediation Committee.
Kim and Park didn’t immediately reply to Thursday requests for comments on the allegations.
Bronsnick, a reporter for NJ Advance Media, said that the employees who work in administrative offices of the building have suffered from “classic” symptoms such as respiratory infections, breathing difficulties, and other problems.
Bronsnick wrote: “Our clients are demanding immediate action in order to correct this issue due to the failure by the Borough to address mold properly.”
The letter says that “the continued failure by the Borough to rectify the mold conditions and employees’ exposure would result in further medical injuries and damage.” The borough is liable for failing to deal with mold and the health issues of its clients.
This letter was sent one day after NJ Advance Media ran a report about the public works department of the Borough abandoning Broad Avenue because it had dozens and dozens fire code violations, as well as other environmental hazards.
Built in 1960, this complex houses the offices of police, fire, and the building department. It also contains the chambers for the borough council, as well as the clerk’s and municipal works departments.
Austin Ashley, the director of Public Works, had ordered in August that his team abandon the second-floor of the building, citing 46 violations of fire code state, which officials of the borough still hadn’t corrected.
Keith Bobrowski a researcher with the New Jersey Department of Health informed Borough Administrator Dave Lorenzo in an email dated Sept. 18, that the state received a report about the environmental hazards within the building.
The email obtained by NJ Advance Media last week states that “the building is presumed to contain asbestos-containing materials, and there may be mold in the areas where staff and police are expected to work.”
Bobrowski wrote that the heating, ventilation and air conditioning system was inoperative and a temporary unit of air conditioners is not adequate. He is a member of the Public Employees Occupational Safety and Health Program.
The borough administrator lamented “the lack direction” from the local government on the way to deal with the numerous issues identified in a response dated 29 September.
Lorenzo, in an email, wrote that the building had been plagued by mold, asbestos and fire code violations. Most of the members of the governing board insist the problems with the building should be repaired without much expense.
Lorenzo stated that “at least 50 claims for first-report injuries have been made by employees due to the hazardous conditions” and that “the borough spent more than $100,000 [to prove] that the building’s conditions are dangerous.”
Lorenzo wrote: “They (the Council) have not spent much on the root causes of problems.” This wastes tax payer money and puts the employees of the Borough at risk, as well as the general public. “The health and safety for borough workers and public is at risk.”
